Terms of service

How we work with you, in writing.

Ark Visibility's terms of service, in short: the free audit is free, carries no obligation, and the reports are yours outright. Paid work is ordered by the piece or by the month, approved by you before it is published, and billed only after you approve it. There is no contract and no lock-in; a monthly plan ends at the close of whichever month you choose. We don't promise search rankings, and nothing on this site is legal or medical advice.

Who we are

These terms are between you and Ark Visibility, a marketing company based in Omaha, Nebraska (“we,” “us”). By requesting a free audit, ordering work, or using this website, you agree to them.

The free audit

  • It is free. There is no card, no obligation and no time limit on deciding what to do with it.
  • It is prepared from public information: your website, your Google Business Profile, directory listings and live search results. We don't ask for logins to prepare it. If you later grant read-only access for the optional deeper report, you can revoke it at any time.
  • We aim to deliver within two business days. If something delays us, we'll email you. A delay doesn't create a claim against us.
  • The reports are yours. You may act on them yourself, give them to another provider, publish them, or hire us. The one thing we ask is that you don't present them as another company's work.
  • We prepare audits for medical and health practices in the United States, of any size. We may decline one, for example if the site isn't a practice or if a crawl would be unreasonably large. We'll say so rather than go quiet.

Paid work, by the piece

  • Prices are the ones published on the pricing page on the day you order. If a price changes, work you've already ordered stays at the price you ordered it at.
  • Every piece is drafted away from your live site and sent to you with the reasoning. You approve it, ask for changes, or decline it.
  • A piece is billed when you approve it, not before. Once approved, it is billed even if you later change your mind about it. The Audit fix-up is one fixed-price piece, billed when you approve the finished work.
  • Reasonable revisions before approval are included. A piece you approved and then want rewritten for a new reason is a new piece.
  • Invoices are due within 14 days. We may pause further work while an invoice is overdue.

Paid work, by the month

  • There are two monthly plans, Upkeep and Managed, at the prices on the pricing page. Each is confirmed to your practice in writing before it starts, including anything a second location adds. The price doesn't change without your written agreement.
  • Both run month to month, billed at the start of each month. Either of us can end a plan at any time; it ends at the close of the month you're in, and that month is billed. There is no notice period and no cancellation fee.
  • On the Managed plan, the pieces on each month's list are ordered at the per-piece prices and billed as you approve each one, in addition to the monthly fee.
  • Month one of the Managed plan includes the Deep Assessment, which is yours to keep whether or not you continue. A Deep Assessment bought on its own is credited in full against the Managed plan if that plan starts within 60 days.
  • If we don't deliver what was agreed for a month, we'll tell you before you find out, and we'll credit or reduce that month's invoice accordingly.

Your approval and your name

  • We publish nothing on your website, your Google Business Profile or any directory without your approval.
  • You are responsible for the accuracy of clinical and professional claims published under your name. We draft; a clinician at your practice reviews every clinical claim and citation before publication.
  • We won't publish claims that can't be supported, and we won't add keywords to a business name or create listings for locations where you don't practice, even if asked.

Accounts and ownership

  • Your domain, website platform, Google Business Profile, directory profiles and any software accounts stay in your name. We work as a manager or contributor you can remove at any time.
  • Everything we produce for you and you've paid for is yours: pages, articles, reports, listing text and the reasoning behind them. We keep the right to reuse our own general methods, templates and know-how.
  • For per-piece work, third-party tools such as BrightLocal run on accounts in your name and are billed by the provider to you, under the provider's own terms. On either monthly plan, those tools are included in the monthly price and run on accounts we hold, with the data exported to you on request and when the plan ends. We don't resell tools, mark them up, or take commissions or referral fees from any vendor, including scheduling software.
  • We don't place call-tracking numbers on your listings or directory records.
  • You give us the access we need to do the work you've ordered, and you're responsible for the accuracy of the information you give us about your practice.

What we don't promise

  • We don't guarantee search rankings, map positions, AI citations, traffic, patients or revenue. Search and AI systems change and are outside anyone's control. Google itself says no one can guarantee a ranking.
  • Ranking reports are measurements taken at a stated time from stated points, not forecasts.
  • Nothing on this site or in our reports is legal, medical, tax or compliance advice. Where we flag a legal or compliance question, your own adviser decides.

Patient information

Our work doesn't require patient information and we ask you not to send us any. Systems that hold patient information, such as your electronic health record, scheduling back end, patient portal and intake forms, are out of scope for every service we offer, including the monthly plans. We are not a HIPAA business associate for the free audit, per-piece work or the monthly plans as described. Where a monthly plan gives us a manager role on your Google Business Profile or a role on your website, you'll restrict that role so it can't expose form or booking submissions, and we'll tell you if we find it can. If any work would ever involve access that could expose patient information, a business associate agreement would be signed before that access is granted. See our privacy policy.

Liability

To the extent the law allows, our total liability to you for anything arising from our work is limited to the amount you paid us for that work in the three months before the claim. We aren't liable for indirect or consequential losses, including lost revenue, lost patients or the actions of search engines, directories or software providers. Nothing here limits liability that can't be limited by law.

Ending the relationship

You can stop at any time. Per-piece work ends when you stop ordering; a monthly plan ends at the close of the current month, and that month is billed. When it ends, we hand back or leave in place everything you've paid for, export any tracking data held on our accounts, remove our access to your accounts on request, and delete the working files we hold for you when you ask.

Changes to these terms

If we change these terms, the new version is posted here with a new effective date. Work already ordered stays under the terms in force when it was ordered.

Governing law

These terms are governed by the laws of the State of Nebraska. If we have a dispute, we'll try to resolve it by talking first.
